1. Acceptance of Terms

Welcome to NastaBox. By accessing or using our website (the "Site"), our mobile applications, and the services we offer (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not access or use our Services.

These Terms apply to all visitors, users, parents, school coordinators, delivery partners, and others who access or use the Services.

2. Website Terms of Use

To ensure a safe, reliable, and respectful environment for all users of the NastaBox platform, you agree to comply with the following policies and guidelines:

  • Permitted Use: You may use the Site and App solely for personal, non-commercial purposes, including managing school lunch subscriptions for your children.
  • Account Security: When you register an account, verification is conducted via a secure One-Time Password (OTP) sent to your mobile number. You are solely responsible for keeping your credentials secure and notifying us immediately of any unauthorized access.
  • Prohibited Activities: You shall not engage in any activity that disrupts, harms, or interferes with the Services, including but not limited to:
    • Attempting to gain unauthorized access to our servers, user databases, or administrative dashboards.
    • Using any automated system, scraper, or software to extract data from the website without our explicit written consent.
    • Using the Service for any fraudulent, illegal, or deceptive activities.
    • Submitting false or misleading student information, delivery details, or payment transaction details.
  • Compliance with Laws: You agree to comply with all applicable local, state, and national laws and regulations while utilizing our Services.

3. Scope of Services & Deliveries

NastaBox provides specialized lunch planning and delivery services. Meals are prepared according to scheduled configurations at our partner kitchen hubs and delivered directly to the child's desk at participating schools.

  • Delivery Coordination: We require accurate child details, including school name, standard, division, medium, and recess break time, to execute deliveries. Inaccurate details may result in delivery failure.
  • Absences and Roll-overs: If a student is absent, you must notify us through the app prior to our cutoff time to pause meal preparation and rollover the balance/credits. Pauses requested after the cutoff time will not be eligible for rollover.

4. Intellectual Property Rights

All content, features, and functionality on the Site and App, including but not limited to code, designs, graphics, text, images, logos, and software, are the exclusive property of NastaBox or its technology developer, TechnoThumb LLP, and are protected by copyright, trademark, and other intellectual property laws.

5. Limitations of Liability

CRITICAL LEGAL NOTICE

To the maximum extent permitted by applicable law, in no event shall NastaBox, its owners, operators, affiliates, directors, employees, delivery partners, or software developers (including TechnoThumb LLP) be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages whatsoever (including, without limitation, damages for loss of profits, data loss, business interruption, or personal injury) arising out of or in connection with:

  • The use or the inability to use our Site, App, or Services.
  • Any errors, mistakes, or inaccuracies of content on the platform.
  • Food preparation, ingredients, dietary specifications, or allergy alerts, save for our commitment to standard kitchen hygiene and health regulations. Parents are responsible for reviewing menu plans against their children's specific allergies.
  • Late or missed deliveries resulting from traffic, weather, school scheduling changes, recess timing shifts, or wrong school information provided by the user.
  • Any unauthorized access to or use of our secure servers and/or personal/financial information stored therein.
  • Any interruption or cessation of transmission to or from our website or servers.

Our liability for any verified claim arising out of our services is strictly limited to the amount paid by you for the specific meal subscription in question.

6. Indemnification

You agree to defend, indemnify, and hold harmless NastaBox, its parents, affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, and developers (including TechnoThumb LLP) from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Services.

7. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post the revised terms on this page and update the "Last updated" date. Your continued use of the platform after changes are posted constitutes acceptance of those changes.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the courts located in Jamnagar, Gujarat, India.
